1. Accepting these terms

These terms cover your use of the website at cactuscontainerstx.com. By using the site you accept them. If you do not accept them, please do not use the site.

These terms are about the website. They are not the terms of any purchase, rental or rent-to-own agreement. Those are set out in the quote, invoice or agreement you sign.

In these terms, “we”, “us” and “Cactus Containers” mean Cactus Containers LLC, a Texas limited liability company. Written correspondence about these terms can be sent to P.O. Box 326, Decatur, TX 76234.

2. What this site is

This is an informational website and a way to request a quote. It is not a shop. You cannot buy anything on it, there are no user accounts, and no payment is taken through it. Everything on the site is an invitation to get in touch and talk about what you need.

3. Prices and estimates

This is the most important section on the page, so it is worth being blunt about it.

• Every price shown on this site is an estimate. That includes container prices, the figures produced by the delivery price estimator, and any price shown on a product or landing page.
• Prices are subject to change without notice. Container costs, freight rates and availability move, sometimes quickly.
• Prices are plus tax if applicable. Any sales or use tax that applies is added on top of the figures shown.
• Delivery estimates depend on the information you give us. The estimator prices freight from the yard it thinks is nearest, based on the ZIP code you type in. The real cost depends on the actual site, the access to it and the conditions on the day.
• An estimate is not an offer and not a reservation. Seeing a price on the site does not hold a container for you and does not lock in that price.

A written quote is valid for 14 days from the date it is issued, unless the quote itself states otherwise. After that, ask us to re-quote — container costs and freight rates move, and we would rather give you a current number than honour a stale one badly.

4. When a sale is actually formed

No sale, rental or other agreement is formed until Cactus Containers issues a written quote and you accept it. Submitting the quote form, using the price estimator, calling a yard or exchanging emails does not by itself create a binding agreement, and does not oblige us to supply a container at any particular price.

We may decline or withdraw a quote, and we may correct a pricing or description error on the site or in a quote, at any time before it has been accepted.

Written confirmation accepts a quote. Replying to a quote by email to say go ahead is enough to form the agreement — it does not have to be a signature. Because of that, keep the quote you are agreeing to: the container, the price, the yard and the specification on that document are the terms you have accepted.

Deposits, cancellation, delivery and warranty are all set out in the sales contract you sign — not on this page. Ask us for a copy before you commit to anything.

5. Quote requests and how we contact you

When you send a quote request you are asking us to get back to you, and we will — by phone, text or email, using the contact details and consents you gave us. The quote form has separate tick boxes for messages about your quote and for marketing messages; what we send you depends on which of those you agreed to. You can stop texts at any time by replying STOP.

Please give us accurate contact and site details. If the delivery address, access or ZIP code you give us is wrong, the price we quote will be wrong too.

6. Product descriptions and availability

We describe our containers as accurately as we can. Containers are industrial units and used ones carry the marks of the work they have done — surface rust, dents, scratches, patched paint and previous owners’ markings are normal and are not defects.

Photographs on this site illustrate the type of unit and are not photographs of the specific container you will receive. Dimensions and specifications are nominal, and stock changes constantly, so anything shown here may be unavailable by the time you ask about it.

The condition grade for your container is stated on your quote, and the terms of any purchase are set out in the sales contract you sign.

7. Rent-to-own

Cactus Containers offers rent-to-own on containers. Rent-to-own is a rental agreement with an option to own at the end of the term — it is not a loan and it is not a credit product. Applications are handled through a rental partner, and the terms of any rent-to-own agreement are set out in that agreement, not on this website.

Any rent-to-own figures shown on this site are illustrative estimates only.

Cactus Containers is a referrer. If you want rent-to-own, we introduce you to Rental Partners. They run the application, the agreement and the payments; we sell you the container. We are not a party to your rent-to-own agreement and we do not set its terms.

Any monthly figure shown on this site is indicative. Your actual terms come from Rental Partners, and their agreement and privacy notice govern that side of the deal.

8. Delivery

Delivery estimates on this site assume a site a truck can reach and a level, firm, clear area big enough to set the container down. The real cost depends on the actual site and the access to it.

What we need from you before delivery day, and how placement works, is explained on the delivery page. The terms that apply to your delivery are in the sales contract you sign.

9. Our content

The text, photographs, video, graphics, logos and layout on this site belong to Cactus Containers or to the people we licensed them from. You are welcome to view, print and share pages for your own use in deciding whether to buy from us. Please do not copy our content to use commercially, or use the Cactus Containers name or logo, without our written permission.

10. Acceptable use

Please do not use this site to do anything unlawful, and please do not:

• submit false, misleading or someone else's contact details through the quote form;
• send automated or bulk submissions, scrape the site, or try to extract our pricing data systematically;
• attempt to interfere with the site, or with the systems it relies on;
• use the site or our contact details to send unsolicited advertising to us.

11. Third-party content and links

Parts of this site are supplied by other companies. In particular, the quote form is provided and hosted by GoHighLevel, and the site's typefaces are loaded from a font service. The site also links to other websites, such as our social media profiles.

We do not control other companies' websites or services and we are not responsible for their content, their availability or their privacy practices. Their terms and privacy notices apply when you use them.

12. Disclaimers

The information on this site is provided for general guidance. We work to keep it accurate and current, but we do not promise that everything is complete, accurate or up to date at any given moment, and specifications, prices and availability change.

Nothing on this website is a warranty. The warranty position for anything you buy is set out in the sales contract you sign.

13. Limitation of liability

This website is provided as-is, for information. To the fullest extent permitted by law, we are not liable for any loss arising from your use of, or inability to use, this site, or from reliance on information on it.

Liability in connection with anything you purchase is governed by the sales contract you sign.

14. Governing law

Your use of this website is governed by the laws of the State of Texas.

The law governing a purchase is set out in the sales contract you sign, and may differ.

15. Changes to these terms

We may update these terms as the business changes. The version on this page is the one that applies, and the effective date at the top shows when it last changed.
